ScamCheck Terms & Conditions

Effective Date: September 10, 2026

These Terms & Conditions govern your use of ScamCheck, including ScamCheck's website, telephone consultation service, and related features. By using ScamCheck or purchasing a consultation, you agree to these Terms & Conditions.

Business Operator

ScamCheck is currently operated as a sole proprietorship under the ScamCheck name. References in these Terms to “ScamCheck,” “we,” “us,” or “our” refer to the operator of the ScamCheck service and, where applicable, its contractors and service providers.

1. Purpose of ScamCheck

ScamCheck provides customers with an opportunity to speak with a person about a situation they believe may involve a scam, fraud, suspicious communication, or other potentially deceptive activity. ScamCheck is intended to help customers slow down, discuss what happened, ask questions, and consider possible next steps.

2. ScamCheck Provides Opinions — Not Guarantees

A ScamCheck assessment is an opinion, not a guarantee or certification that something is legitimate, fraudulent, safe, or unsafe.

ScamCheck cannot independently verify every statement, person, company, transaction, communication, website, or circumstance described during a consultation. Scammers and fraudulent schemes continually change, and information available during a consultation may be incomplete or inaccurate.

Automated AI Scam Analysis

ScamCheck may provide a free automated AI-based analysis of information submitted by a user. This automated analysis is provided for informational purposes only and may be incomplete, inaccurate, or incorrect.

An automated analysis does not guarantee or certify that any person, message, company, transaction, website, or communication is legitimate, fraudulent, safe, or unsafe. You should not send money, disclose sensitive information, or make important decisions solely because of an automated ScamCheck analysis.

Automated analysis is separate from a consultation with a human ScamCheck advisor and is not a substitute for professional, legal, financial, cybersecurity, law-enforcement, or emergency assistance when such assistance is appropriate.

3. You Remain Responsible for Your Decisions

You are responsible for deciding what actions to take or not take after a ScamCheck consultation. ScamCheck does not make decisions on your behalf and cannot guarantee that following or declining to follow an advisor's opinion will prevent financial loss, identity theft, fraud, or other harm.

4. Accuracy of Information You Provide

ScamCheck's ability to provide a useful opinion depends on the information you provide. You agree to provide information that is accurate and complete to the best of your knowledge. ScamCheck is not responsible for an assessment affected by incomplete, inaccurate, misleading, or omitted information.

5. ScamCheck Is Not Professional Advice

ScamCheck is not a law firm, financial institution, accounting firm, investment adviser, credit counseling agency, cybersecurity firm, law enforcement agency, government agency, or emergency service.

ScamCheck consultations do not constitute legal, financial, investment, tax, accounting, cybersecurity, or other licensed professional advice. When appropriate, you should contact the relevant financial institution, attorney, government agency, law enforcement agency, or other qualified professional.

6. Emergencies and Active Fraud

ScamCheck is not an emergency service and is not a substitute for 911, law enforcement, your bank, credit card company, or other appropriate emergency or fraud-response service.

If you believe money is currently being stolen, an account has been compromised, you are in immediate danger, or a crime is actively occurring, contact the appropriate financial institution, law enforcement agency, emergency service, or other appropriate authority immediately.

7. Consultation Fee

Unless a different price is clearly disclosed before purchase, a ScamCheck consultation costs $10.00.

The consultation fee pays for access to the consultation service. It does not purchase or guarantee a particular conclusion, result, recovery, reimbursement, or outcome.

8. Family Plan Prepaid Consultations

The ScamCheck Family Plan provides 5 prepaid ScamCheck consultations for $50.00. The prepaid consultations are assigned to the recipient telephone number entered at the time of purchase. Prepaid consultations do not expire, are not a subscription, and do not renew automatically.

A prepaid consultation is used only when a ScamCheck advisor accepts the call. If an advisor is unavailable, does not accept the call, or the call does not connect, a prepaid consultation will not be deducted.

Unused prepaid consultations are not redeemable for cash. Consultations that have already been used are non-refundable. If the recipient changes telephone numbers, remaining prepaid consultations may be transferred to a new telephone number after reasonable verification by ScamCheck.

9. Telephone Service

By requesting a ScamCheck consultation and providing a telephone number, you authorize ScamCheck and its communications providers to place calls necessary to provide the consultation you requested.

You are responsible for providing a telephone number that you are authorized to use and for any charges imposed by your telephone provider.

10. Information and Materials You Submit

You may choose to provide information such as messages, screenshots, photographs, emails, or descriptions of suspicious communications. You represent that you have the right to provide the materials you submit for purposes of receiving the ScamCheck service.

Do not send passwords, PIN numbers, Social Security numbers, complete banking login credentials, complete payment-card information, or other highly sensitive authentication information.

11. Availability of the Service

ScamCheck does not guarantee that an advisor, website, telephone connection, payment system, or other part of the service will always be available or uninterrupted. We may modify, suspend, restrict, or discontinue portions of the service when reasonably necessary.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ScamCheck will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the service.

ScamCheck is not responsible for losses resulting from decisions you make based on, or contrary to, an opinion provided during a consultation, except to the extent such liability cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, ScamCheck's aggregate liability arising from a particular paid consultation will not exceed the amount you paid ScamCheck for that consultation.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Third-Party Conduct

ScamCheck is not responsible for the conduct, statements, products, services, websites, transactions, or actions of scammers, merchants, financial institutions, telecommunications providers, websites, or other third parties.

14. Service Provided "As Is"

To the maximum extent permitted by law, ScamCheck and its services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, except for warranties that cannot legally be excluded.

15. Binding Individual Arbitration

Please read this section carefully because it affects how disputes may be resolved.

To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to ScamCheck, a consultation, a payment, these Terms & Conditions, or your use of the service will be resolved through binding individual arbitration rather than a lawsuit in court, except for matters that may legally be brought in small claims court or matters that applicable law does not permit to be arbitrated.

Before beginning arbitration, the party asserting a dispute must provide written notice describing the dispute and requested resolution and allow the other party 30 days to attempt to resolve the matter informally.

Arbitration will be administered by a recognized arbitration provider mutually agreed upon by the parties. If the parties cannot agree, the provider or arbitrator will be selected as permitted by applicable law. Arbitration fees and costs will be allocated according to the applicable arbitration rules and law.

Each party will ordinarily be responsible for its own attorneys' fees unless these Terms, applicable law, or the arbitration award provides otherwise.

16. Class and Representative Action Waiver

To the maximum extent permitted by applicable law, disputes must be brought on an individual basis and not as a plaintiff or class member in a purported class, collective, consolidated, or representative proceeding.

17. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

For any dispute that is not subject to arbitration and may lawfully be heard in court, the parties consent to an appropriate court located in Florida to the extent permitted by applicable law.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

19. Changes to These Terms

ScamCheck may update these Terms & Conditions from time to time. The effective date shown at the top of this page will identify the current version. Your continued use of ScamCheck after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

20. Entire Agreement

These Terms & Conditions, together with the ScamCheck Privacy Policy and any other terms presented to you as part of a specific service, constitute the agreement governing your use of ScamCheck.
